These Terms of Service ("Terms") govern your access to and use of the Digital Tap AI platform and website at digitaltap.ai (the "Service"), operated by Digital Tap AI ("we," "us," or "our"), . By accessing or using the Service, you agree to be bound by these Terms.
Digital Tap AI is a Software-as-a-Service (SaaS) platform that provides intelligent cluster optimization for cloud data platforms including Databricks, Amazon EMR, Azure Synapse, and Google Dataproc. The Service predicts idle periods, hibernates unused clusters, pools shared capacity, and orchestrates spot instances to reduce compute costs and water consumption.
To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
Digital Tap AI uses a simple, predictable tiered pricing model based on your Databricks spend level. All plans include a savings guarantee: we save you 3-4× your subscription cost, or you get a full refund. Tiers: Starter ($3K/mo for under $50K spend), Growth ($8K/mo for $50K-$200K spend), Scale ($20K/mo for $200K-$1M spend), Enterprise (custom for $1M+ spend).
If you believe a savings calculation is incorrect, you may dispute the invoice within 15 days by contacting us at hello@digitaltap.ai. We will review the calculation and provide supporting data.
To provide the Service, we require read access to cluster metadata and usage metrics from your cloud data platforms. This includes:
We do not access, read, copy, or store your actual data, query results, datasets, or business logic. We operate exclusively on infrastructure metadata.
You agree to:
The Service, including all software, algorithms, models, designs, and documentation, is owned by Digital Tap AI and protected by intellectual property laws. You retain full ownership of your data. We claim no rights over your cluster data or business information.
We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by third-party services, force majeure events, or circumstances beyond our control.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL TAP AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Digital Tap AI does not guarantee specific cost savings. Savings estimates are based on historical usage patterns and may vary. The Service provides optimization recommendations and automated actions; you are responsible for validating that these actions are appropriate for your environment.
You agree to indemnify and hold harmless Digital Tap AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
